About These Terms
These Terms of Service ("Terms") govern your access to and use of the SMH Luxe Stays LLC platform, including all booking services for short-term rental properties and vehicles. By accessing our platform, creating an account, or completing a booking, you agree to be legally bound by these Terms in their entirety.
These Terms constitute a legally binding agreement between you and SMH Luxe Stays LLC, a Delaware Limited Liability Company. If you do not agree, you must discontinue use of the platform immediately.
Who These Terms Apply To
  • Guests — individuals booking properties or vehicles
  • Hosts — property and vehicle owners listing on the platform
  • Visitors — anyone browsing the SMH Luxe Stays platform
  • Partners — third-party service providers and affiliates
Section 1
Booking Process & Acceptance of Offer

Submit a Booking Request
Guests select their desired property or vehicle, choose dates, and submit a booking request through the platform. Submission does not guarantee confirmation.

Review & Verification
SMH Luxe Stays LLC and/or the Host reviews the request. Identity verification, payment pre-authorization, and eligibility checks are completed at this stage.

Booking Confirmation
Upon acceptance, a confirmation notice is sent via email. A binding contract between Guest and Host is formed at this moment, governed by these Terms.

Pre-Stay Checklist
Guests must review listing rules, sign any required addenda, and ensure all payment obligations are satisfied prior to check-in or vehicle pickup.

A booking request is an offer to purchase rental services. SMH Luxe Stays LLC reserves the right to decline any request at its sole discretion, without liability to the requesting party.
Section 2
Invoicing & Payment Terms
Payment Schedule
All bookings require full payment or a confirmed deposit at time of booking confirmation. The following charges apply to every reservation:
  • Base Rental Fee — nightly/daily rate as listed
  • Service Fee — platform fee calculated at checkout
  • Taxes — applicable local, state, and occupancy taxes
  • Security Deposit — held and released per policy
  • Add-On Charges — optional services selected by Guest
Accepted Payment Methods
  • Major credit and debit cards (Visa, Mastercard, Amex)
  • ACH bank transfer (pre-approved accounts only)
  • Wire transfer for reservations exceeding $5,000
Late & Failed Payments
Failed payments result in automatic booking suspension. A $50 administrative fee applies to each failed transaction. SMH Luxe Stays LLC may cancel unresolved bookings after 48 hours without refund of any amounts already collected.

All invoices are denominated in U.S. Dollars (USD). SMH Luxe Stays LLC is not responsible for currency conversion fees charged by your financial institution. Invoices are final upon booking confirmation.
Section 3
Cancellation & Refund Policy
🟢 Flexible
Full refund if cancelled 48+ hours before check-in. Service fee non-refundable. Applies to select listings only.
🟡 Moderate
50% refund of base rental fee if cancelled 5+ days before check-in. No refund within 5 days of arrival.
🔴 Strict
No refund within 14 days of check-in. 50% refund only if cancelled 14+ days prior. Non-negotiable for luxury tiers.
🚗 Vehicle Rentals
Full refund if cancelled 72+ hours before pickup. 50% within 72–24 hours. No refund within 24 hours of pickup.
The applicable cancellation policy is displayed on each listing prior to booking and confirmed in the booking confirmation email. SMH Luxe Stays LLC platform service fees are non-refundable under all policies. Security deposits are released within 7 business days following departure, subject to damage review.
Section 4
Responsibilities of Guests & Hosts
Guest Responsibilities
  • Provide accurate identification and payment information
  • Comply with all house rules and vehicle use policies
  • Treat the property or vehicle with reasonable care
  • Report damage or incidents immediately to SMH Luxe Stays
  • Vacate or return by the agreed checkout/return time
  • Not sublet, share access, or exceed maximum occupancy
  • Comply with all local laws, ordinances, and HOA rules
Host Responsibilities
  • Maintain accurate, truthful, and current listing information
  • Ensure the property or vehicle meets all safety standards
  • Honor confirmed reservations and provide agreed amenities
  • Carry appropriate insurance coverage at all times
  • Comply with all applicable short-term rental regulations
  • Respond promptly to Guest inquiries and platform communications
  • Not engage in discriminatory booking or pricing practices

Guests found in violation of occupancy rules, causing damage, or engaging in illegal activity on premises will forfeit their security deposit in full and may be permanently banned from the platform. SMH Luxe Stays LLC reserves the right to pursue additional legal remedies.
Section 5
Professional Offer Agreement (Public Offer)
This section constitutes the Public Offer Agreement (Public Offer Agreement) of SMH Luxe Stays LLC and sets forth the terms under which the Company offers its rental intermediary services to all users. Acceptance of these terms through platform use or booking completion constitutes full and unconditional acceptance of this Offer.
1. Offeror
SMH Luxe Stays LLC, a Delaware Limited Liability Company, operating the short-term rental booking platform accessible at its official domain and affiliated applications.
2. Subject of the Agreement
The Company provides an intermediary booking platform connecting Guests with Hosts offering short-term rental of residential properties and vehicles. SMH Luxe Stays LLC is not itself a landlord or vehicle lessor.
3. Acceptance (Acceptance)
This Offer is deemed accepted upon the user completing registration, submitting a booking request, or listing a property or vehicle on the platform. Acceptance is unconditional and full.
4. Term & Modification
This Offer is valid indefinitely. SMH Luxe Stays LLC reserves the right to modify, suspend, or withdraw this Offer at any time with notice posted on the platform. Continued use constitutes acceptance of updated terms.
5. Obligations of the Company
The Company will provide the platform in good faith, process payments in a commercially reasonable manner, and maintain reasonable technical uptime. Platform availability is provided "as is" without warranty of uninterrupted service.
6. Obligations of the Acceptor
Users agree to provide truthful information, comply with all applicable laws, fulfill all financial obligations, and not misuse the platform in any manner that causes harm to the Company, other users, or third parties.
Section 6
Intellectual Property
SMH Luxe Stays LLC Owns Its Platform
All content on the SMH Luxe Stays platform — including but not limited to logos, trademarks, trade dress, website design, software, photography, written content, and compiled listing data — is the exclusive intellectual property of SMH Luxe Stays LLC or its licensors.
Users are granted a limited, non-exclusive, revocable, non-transferable license to access and use the platform solely for its intended purpose. No rights are transferred to you beyond this limited license.
Prohibited Uses
  • Copying or reproducing platform content
  • Reverse engineering any platform technology
  • Using SMH trademarks without written consent
  • Scraping or automated data extraction
  • Reselling or sublicensing platform access

User-Generated Content: By submitting reviews, photos, or listing content to the platform, you grant SMH Luxe Stays LLC a worldwide, royalty-free, perpetual license to use, display, and distribute such content in connection with platform operations.
Section 7
Limitation of Liability
Platform Role
SMH Luxe Stays LLC operates solely as an intermediary marketplace. We are not a party to the rental agreement between Guest and Host and accept no liability for the condition, safety, or availability of any listed property or vehicle.
Liability Cap
To the maximum extent permitted by law, SMH Luxe Stays LLC's total liability to any user shall not exceed the total fees paid to the Company in the three (3) months immediately preceding the claim.
Excluded Damages
SMH Luxe Stays LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or personal injury arising from platform use.

Force Majeure: SMH Luxe Stays LLC is not liable for service interruptions caused by events beyond its reasonable control, including natural disasters, governmental actions, cyberattacks, or infrastructure failures.
Section 8
Governing Law, Termination & Disputes
Governing Law & Jurisdiction
These Terms are governed exclusively by the laws of the State of Delaware, USA, without regard to its conflict of law provisions. Any disputes not resolved through arbitration shall be subject to the exclusive jurisdiction of the courts of the State of Delaware.
Dispute Resolution
Before initiating legal proceedings, parties agree to attempt resolution through good-faith negotiation. Unresolved disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA). Class action waiver applies.
Account Termination
SMH Luxe Stays LLC may suspend or permanently terminate any user account at its sole discretion for:
  • Violation of these Terms or platform policies
  • Fraudulent or deceptive conduct
  • Chargebacks or payment disputes filed in bad faith
  • Conduct harmful to other users or the platform
  • Failure to comply with applicable law
Termination does not relieve users of outstanding payment obligations.

Legal Notices
All formal legal notices must be submitted in writing to the email address above with the subject line "Legal Notice — SMH Luxe Stays LLC." Notices become effective upon written acknowledgment by the Company.
Amendments
SMH Luxe Stays LLC reserves the right to update these Terms at any time. Material changes will be communicated via platform notification or email. Continued use following notice constitutes acceptance.
